Terms and Conditions

• "Platform" means the contest creation, management, and voting software operated by us at castthecrown.com.
• "Contest Admin" means any individual or business that creates and manages a contest using the Platform.
• "Contestant" means any individual who submits an entry to a contest hosted on the Platform.
• "Voter" means any individual who casts a vote in a contest hosted on the Platform.
• "User" means any person who accesses the Platform in any capacity.
• "Content" means any photos, text, videos, or other material uploaded to the Platform.

We are a technology platform only. We provide tools for Contest Admins to create and manage contests. We do not organize, sponsor, endorse, or administer any specific contest hosted on the Platform. We are not responsible for the conduct, decisions, or outcomes of any contest. All contest rules, prizes, judging criteria, and winner selection are the sole responsibility of the Contest Admin. Contest Admins are solely responsible for compliance with any applicable sweepstakes, contest, or promotion laws for their specific event.

You must be 18 years of age or older to create an account, submit a contest entry, or use the Platform, unless a specific contest's rules explicitly permit parental consent for minors.

Contests involving alcohol.

If a contest involves alcohol in any way — including but not limited to alcohol brand sponsorship, alcohol as a prize, or alcohol present/served/judged at an associated event — the minimum age to participate as a Contestant or Voter for that specific contest is 21 years of age or older, regardless of the general 18+ Platform minimum. It is the Contest Admin's responsibility to set and enforce the correct minimum age for their specific contest, in compliance with applicable state and local alcohol laws.

By using the Platform, you represent that you meet the applicable age requirement for each contest you participate in.

• Provide accurate information about your contest, including dates, rules, and prizes.
• Set contest-specific rules that do not conflict with these Terms.
• Fairly review and moderate contestant submissions.
• Honor any prizes or awards you advertise.
• Comply with all applicable laws governing contests, sweepstakes, and promotions in your jurisdiction.

• Submit only original content that you own or have the right to use.
• Provide accurate information in your entry.
• Agree to and follow both these Terms and the specific rules of each contest you enter (see Section 16, Default Contest Rules).
• Not attempt to manipulate voting in any contest.

Votes must be cast by real individuals. Automated, bulk, purchased, or otherwise manipulated votes are prohibited. Contest Admins may set contest-specific voting rules (e.g., voting frequency, voting method) within the tools provided by the Platform. We reserve the right, and Contest Admins have tools, to detect and remove fraudulent votes and disqualify contestants who manipulate voting. Vote counts may be hidden from public view at a Contest Admin's discretion (see each contest's specific settings); Contest Admins can always view real vote counts regardless of public visibility settings.

Ownership. You retain ownership of any photos, bios, and other Content you submit.

License to us. By submitting Content, you grant us and the relevant Contest Admin a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that Content on the Platform (including public contest pages, QR codes, printable posters, and promotional materials) for as long as your contest or entry remains active, or as needed to operate the Platform.

Your responsibility. You represent that you own or have the right to submit any Content you upload, and that it does not violate any third party's rights or any applicable law.

You agree not to:

• Use the Platform for any unlawful purpose.
• Attempt to manipulate voting (e.g., duplicate voting, bots, purchased votes).
• Upload Content that is illegal, obscene, defamatory, infringing, or that depicts or involves anyone under 18.
• Attempt to gain unauthorized access to the Platform or other users' accounts or data.
• Interfere with the proper functioning of the Platform.
• Impersonate another person or misrepresent your affiliation with any person or entity.

Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• Contest Admin plan: $29.99/month, billed on a recurring basis until canceled.
• One Contest at a Time: $24.99, one-time payment per contest.

Payments are processed securely by Stripe. We do not store your full card details. All sales are final. We do not offer refunds, except where required by law. You may cancel your subscription at any time; cancellation stops future billing but does not refund the current billing period.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the Platform will be uninterrupted, error-free, or secure, and we make no guarantee about the outcome of any contest.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including damages arising from any individual contest's conduct, judging, or outcome. Our total liability for any claim arising from these Terms or the Platform shall not exceed the amount you paid us in the 12 months prior to the claim.

You agree to indemnify and hold harmless Cholo On A Low Low LLC, its owners, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your Content, or your violation of these Terms.

We may suspend or terminate your account at any time for violation of these Terms. You may stop using the Platform at any time.

Please read this section carefully — it affects your legal rights.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court. Arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA), venued in Los Angeles County, California. You and Cholo On A Low Low LLC each waive the right to a jury trial and to participate in a class action. This arbitration agreement is governed by the Federal Arbitration Act.

These rules are pre-loaded into each contest template. Contest Admins can use them as-is, edit them, or add additional custom rules. Contestants must agree to these rules — in addition to these overall Terms — before submitting an entry to a specific contest. (Template-specific rules will be added to the contest creation flow separately.)

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. If you disagree with any changes, you must stop using the Platform.
